These Terms of Service ("Terms") govern your use of zealmediasolutions.com (the "Site"), operated by Zeal Media Solutions LLC ("Zeal Media Solutions," "we," "us," or "our"). By using the Site, submitting a form, or booking a call, you agree to these Terms. If you do not agree, please do not use the Site.
1. Use of the Site
You may use the Site for lawful purposes only. You agree not to:
- submit false, misleading, or someone else's information through our forms;
- send spam, malware, or automated requests, or attempt to scrape, overload, or gain unauthorized access to the Site or our systems;
- copy, reproduce, or resell Site content except as allowed in Section 6;
- use the Site in any way that violates applicable law or the rights of others.
2. Our services & client agreements
The Site describes marketing services for home improvement contractors, including SEO, Pay-Per-Appointment lead generation, paid advertising, social media marketing, website development, creative design, and AI chatbot and automation. Descriptions, examples, and pricing on the Site are for general information and may change without notice.
Any paid engagement is governed by a separate written agreement, proposal, or insertion order between you and Zeal Media Solutions (a "Client Agreement"). The Client Agreement sets out the scope, fees, appointment qualification and credit rules (for Pay-Per-Appointment), term, and cancellation terms. If anything in these Terms conflicts with a signed Client Agreement, the Client Agreement controls.
3. No guarantee of results
Case studies, statistics, reviews, and results shown on the Site reflect the experience of specific clients in specific markets and time periods. They are not a promise or guarantee that you will achieve the same or similar results. Search rankings, ad performance, lead volume, appointment show rates, and revenue depend on many factors outside our control, including search engine and platform algorithms, your market, competition, pricing, and how your team follows up with leads.
4. Free audits & strategy calls
Free marketing audits and strategy calls are provided for informational purposes, without obligation to buy. Recommendations are based on the information available at the time and do not create a client relationship or any warranty. You may keep and use the findings whether or not you hire us.
5. Calls, texts & emails
By submitting your contact details on the Site, you agree that Zeal Media Solutions may contact you by phone, email, and — if you opt in — text message about your inquiry, including through automated technology. Message frequency varies. Message and data rates may apply. Reply STOP to opt out of texts or HELP for help. Consent is not a condition of purchase. 6. Intellectual property
The Site and its content — including text, graphics, logos, the Zeal Media Solutions name, page designs, case studies, and code — are owned by Zeal Media Solutions or its licensors and protected by copyright, trademark, and other laws. You may view and print pages for your personal, non-commercial reference. Any other use requires our prior written permission. Client logos and names appear with permission and remain the property of their owners.
7. Third-party links & tools
The Site may include links to, or embedded content from, third parties such as Google, Meta (Facebook and Instagram), TikTok, YouTube, Calendly, and GoHighLevel. We do not control and are not responsible for third-party websites, services, content, or privacy practices. Your use of them is subject to their own terms.
8. Disclaimers
The Site and all content are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
9. Limitation of liability
To the fullest extent permitted by law, Zeal Media Solutions and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities, arising from or related to your use of the Site, even if advised of the possibility of such damages. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100). Liability for paid services is governed by the applicable Client Agreement.
10. Indemnification
You agree to indemnify and hold harmless Zeal Media Solutions and its owners, employees, and contractors from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or your violation of these Terms.
11. Governing law & disputes
These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in King County, Washington, and you consent to their jurisdiction.
12. Changes & general terms
We may update these Terms at any time by posting a new version on this page and changing the "Last updated" date. Continued use of the Site after changes means you accept the updated Terms. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, together with our Privacy Policy and any Client Agreement, are the entire agreement regarding the Site.
